Royal Blue WashingThese Terms of Service ("Terms") govern your access to and use of royalbluewashing.com, our online booking and quote system, and the house washing, surface cleaning, sealing, and restoration services provided by Royal Blue Washing ("Royal Blue Washing," "we," "us") (collectively, the "Services"). By using our website, requesting a quote, or booking our Services, you ("you" or "customer") agree to be bound by these Terms. If you do not agree, please do not use our website or book our Services.
THESE TERMS INCLUDE IMPORTANT DISCLOSURES ABOUT PROPERTY ACCESS AND ASSUMPTION OF RISK, AND A LIMITATION OF LIABILITY. PLEASE READ SECTIONS 3 AND 5 CAREFULLY.
1. Permitted and Prohibited Use
(a) Permitted Use. You may use our website and booking system to learn about our services, request quotes, book and manage appointments, and communicate with us for your own lawful purposes.
(b) Prohibited Use. You will not:
- Use our website for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to our website, booking system, or customer records;
- Use automated means, such as bots or scrapers, to access our website without our written permission;
- Upload malicious code or interfere with or disrupt our website's operation or security; or
- Provide false or misleading information about your property or service address when requesting a quote.
2. Intellectual Property
(a) Our Content. Royal Blue Washing owns or licenses all content on our website, including text, images, photos of completed work, logos, and branding ("Our Content"). You may view and share Our Content for personal, non-commercial purposes, but may not reproduce, modify, or use it commercially without our written consent.
(b) Your Photos. If you submit photos of your property for a quote, you retain ownership of them. We will only use photos we take of completed work for our portfolio, website, or marketing with your consent, which you may withdraw at any time as described in our Privacy Policy.
3. Services; Property Access and Assumption of Risk
(a) Property Access and Accurate Information. You agree to provide safe and lawful access to the property and surfaces to be serviced, and to disclose known hazards, fragile or damaged surfaces, sensitive landscaping, and the location of outdoor electrical outlets, sprinkler systems, and pets, so that we can perform the Services safely.
(b) Pre-Existing Conditions. We are not responsible for pre-existing damage, wear, or defects in surfaces, paint, caulking, roofing, or landscaping that are not caused by our work, including conditions that were not visible or disclosed before service.
(c) Assumption of Risk. Soft-washing and pressure-washing services involve water, cleaning solutions, and equipment that carry inherent risks to sensitive surfaces and landscaping. By booking a service, you acknowledge these risks and agree that Royal Blue Washing is not responsible for damage resulting from hazards or conditions you did not disclose under Section 3(a).
(d) Weather and Scheduling. Services are weather-dependent and may be rescheduled at our discretion for safety or quality reasons. We will make reasonable efforts to notify you of any changes.
4. Payment Terms and Refund Policies
(a) Quotes. Quotes are provided free of charge and are estimates based on the information and photos you provide; final pricing may be adjusted if actual conditions differ materially from what was described.
(b) Payment. Payment is due upon completion of service unless otherwise agreed in writing, such as for larger commercial projects.
(c) Satisfaction Guarantee. If you are not satisfied with a completed service, contact us within a reasonable time so we can evaluate and, at our discretion, address the concern through reservice or another appropriate remedy.
(d) Refunds. Fees for services already performed are generally non-refundable, except as expressly provided under Section 4(c) or required by law.
5. Limitation of Liability and Warranty Disclaimers
(a) Disclaimer. Our services are provided using industry-standard soft-wash and pressure-washing methods. We do not guarantee complete removal of all staining, mold, mildew, or discoloration, as results depend on the condition, age, and material of the surface.
(b) Limitation of Liability. To the maximum extent permitted by law, Royal Blue Washing is not liable for indirect, incidental, or consequential damages arising from your use of our website or Services. Our total liability for any claim will not exceed the amount you paid for the service giving rise to the claim.
(c) Insurance. Royal Blue Washing is licensed, bonded, and maintains liability insurance coverage. Nothing in this Section is intended to limit any claim properly covered under that insurance.
(d) Exceptions. Nothing in this Section limits liability where Florida law does not permit such a limit, including for our gross negligence or willful misconduct.
6. Scheduling, Cancellation, and Termination
(a) By You. You may cancel or reschedule a booked appointment by contacting us using the information in Section 9. We appreciate as much notice as possible, particularly for larger or commercial jobs.
(b) By Us. We may decline, reschedule, or discontinue a service if we reasonably believe the property poses a safety risk, if access or disclosed conditions differ materially from what was described, or as described in Section 3(d).
7. Dispute Resolution; Governing Law
(a) Informal Resolution. Before filing a claim, you and Royal Blue Washing agree to first try to resolve the dispute informally by contacting us using the information in Section 9.
(b) Jurisdiction and Venue. Any dispute arising from these Terms or our Services that cannot be resolved informally will be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to the jurisdiction of those courts. Nothing in this Section prevents either party from bringing a claim in small claims court.
(c) Governing Law. Florida law governs these Terms, without regard to conflict-of-law rules.
8. Severability and General Terms
(a) Severability. If any provision of these Terms is found unenforceable, the rest remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
(b) Entire Agreement. These Terms, together with our Privacy Policy and any quote or invoice provided to you, are the entire agreement between you and Royal Blue Washing regarding our website and Services.
(c) Changes to These Terms. We may update these Terms from time to time. Material changes will be reflected by an updated "Effective Date." Continued use of our website or Services after changes take effect constitutes acceptance.
(d) No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
